Svg Legal Age

Although a minor is a person under the age of 18 in SVG, the minimum age at which a person can legally marry is 15 years on the basis of section 4, paragraph 1, of the SVG Marriage Act entitled “Age of marriage” and 16 years for a male person. From the above, it can be seen that the SVG marriage law needs to be amended urgently. Even though child marriage is not currently recognised as a widespread problem in SVG, the law currently legalises the practice and provides a way for children to be abused and exploited. Child marriage should be illegal and severe penalties should be provided to deter adults who attempt to force, pressure or allow children to enter into such marriages. It is well known that many married couples can enter into sexual relations with each other, among other things. On the basis of section 4 (1) of the SVG Marriage Act, I would like to think and believe in my current opinion that at the age of 16, a male person in SVG may be legally capable of consenting to sexual intercourse, because according to the current state of the law, a male person can legally marry in SVG at the age of 16. I respectfully believe that a separate section entitled “Buggery” covering anal sex in relation to individuals may not be necessary, as the definition of rape in the SVG Criminal Code can be expanded if it has not already been made to include non-consensual sex per year. In addition, I believe that Article 123 of the SVG Penal Code should, among other things, explicitly recognize and criminalize male rape, because I believe that a man can also be raped by another man and a woman. There are many other sexual offences listed in the SVG Criminal Code that may apply, among others, to minors who are incapable of consenting to certain sexual acts and/or behaviours, or who are under the age of 18.

After reading many of the sexual offences listed in the SVG penal code, although some of them do not explicitly exclude boys and men, many of them seem to focus more explicitly on protecting girls and women than boys and men. Although progress continues to be made in ending child marriage globally, child marriage is still recognised by law in many states. In particular, many English-speaking countries in the Caribbean Commonwealth, including Saint Vincent and the Grenadines (SVG), still have laws recognising child marriage. As noted above in the case of Belize, women and girls are much more affected by this practice than men and boys and are therefore more vulnerable to abuse and exploitation as a result of these marriages. States, including SVG, have an obligation to respect, protect and fulfil human rights at the national level. This commitment means, among other things, that States must proactively address the issue of child marriage within their respective territories and make the necessary changes to relevant laws to effectively address the issue of child marriage. Chapter 342 Liquor Licence Act (1990), sections 27 and 28 The only two countries in the English-speaking Commonwealth Caribbean to have abolished child marriage are the Republic of Trinidad and Tobago, Antigua and Barbuda. Trinidad and Tobago abolished child marriage in 2017.

Antigua and Barbuda quickly followed, abolishing child marriage in 2019. However, 10 other English-speaking territories in the Commonwealth of the Caribbean continue to recognise child marriage. These are Belize, Bahamas, Jamaica, Saint Kitts and Nevis, Commonwealth of Dominica, Saint Lucia, Saint Kitts and Nevis. Vincent and the Grenadines, Barbados, Grenada and the Co-operative Republic of Guyana. In 2017, the UN Committee on the Rights of the Child stated in its “Concluding Observations on the combined 2nd and 3rd periodic reports of Saint Vincent and the Grenadines: Committee on the Rights of the Child” that it was concerned about “the persistently high prevalence of child maltreatment, including neglect and physical, sexual and emotional abuse and incest” in SVG. In addition, he was also concerned that “child prostitution is often justified by families and child victims themselves as a mechanism for combating poverty” in SVG. In the case of a minor aged 15 or over, but under the age of 18 and with whom an adult may have had unlawful sexual intercourse, this minor may be invoked under article 123 of the SVG Criminal Code, entitled “rape”. If the illegal sexual act on a minor, who may be a man or a woman, is anal sex, a minor may be claimed under Article 146 of the SVG Penal Code entitled “sodomy”.
